The homeowner’s property may be “underwater” in its value. This means the value of the property is far less than the amount owed on the property. The homeowner may even be current on their payments, yet wondering if they should continue to try and regain the loss of equity. In these instances, homeowners are referred to a legal profession to evaluate their alternatives. If liquidation is the preferred avenue of problem resolution, our legal professionals will work with the homeowner and the lender to expedite the disposition of the property. Liquidation could prevent many of the typical negative ramifications associated with a short sale like a deficiency judgment, 1099 tax consequence, and/or elimination of all negative credit.

Real estate professionals that work closely with a legal professional and identify FRAUD, mistakes, and /or violations in mortgage loans can reverse a homeowner’s current negative equity situation on an over-encumbered home by having it invalidated, voided through “rescission,” allowing the homeowner to immediately purchase an “UPGRADE” home for far less than what was owed on the smaller home with current low 30-year fixed financing creating long-term sustainability as well as an improvement in the consumer’s lifestyle.
Revisions to FHA’s Loss Mitigation Home Retention Options
This mortgagee letter includes revised requirements for FHA’s Loss Mitigation Home Retention Options, in an effort to reduce the number of full claims against the FHA Mutual Mortgage Insurance Fund by assisting a greater number of qualified, distressed mortgagors in retaining their homes. No later than 90 days after issuance of this mortgagee letter, mortgagees must begin to assess mortgagors in default under the FHA’s loss mitigation priority order and policies referenced herein.

A Homeownership Preservation Alliance-You and Us!

Once our Nonprofit Organization has submitted our “complete” alternative to foreclosure package to your lender on your behalf, it may make it against both State and or Federal Law to proceed to foreclose on you. We have successfully had many lenders rescind (reverse) the Trustee Sale and put an already foreclosed upon home back into the clients’ name EVEN after they vacated a Non-Owner Occupied Home.
(C.H.A.M.P) Consumer Home Affordable Modification Program
When our nonprofit law clinic reviews the Consumer Home Affordable Modification Program (C.H.A.M.P) results with you that will properly structure your FREE Lender Specific loan proposal based on CHAMP© like guidelines and provide you the required information that your lender will need to approve you for a CHAMP©-like modification, then there will not be any cost or fee. Our nonprofit law clinic is dedicated to making you aware of Consumer Protection products and services that you may need in the future, for example:
- temporary restraining order against a foreclosing lender,
- consumer representation of an unlawful detainer if you are getting evicted from your home,
- lender lawsuits,
- filing a lis pendens on your property making it virtually impossible for your lender to sell your home,
- providing you with a lender fraud and violation analysis report,
- or bankruptcy protection.
